Fashion Open Studio Ltd. Copyright Dispute Policy
In compliance with the Digital Millennium Copyright Act (DMCA), Fashion Open Studio Ltd has established the following policy regarding claims of copyright infringement. We take copyright violations seriously and have established procedures to address them.
We reserve the right to:
- Block Access to Infringing Content: If we determine in good faith that material on our platform has been illegally copied and distributed, we will remove or block access to that material.
- Terminate Accounts of Repeat Offenders: We may suspend or terminate the accounts of users or affiliates who repeatedly violate copyright laws.
It is important to note that your use of Fashion Open Studio services is always governed by our Terms of Use, which includes this Copyright Dispute Policy. Any terms used in this policy without a specific definition should be interpreted as per the definitions provided in our Terms of Use.
Procedure for Reporting Copyright Infringements
If you believe that content hosted by Fashion Open Studio infringes your copyright (or the copyright of someone you are authorized to represent), you may report the infringement by submitting a DMCA Takedown Notice to our Designated Agent. Your notice must include the following information:
1. Signature Information
- Physical or Electronic Signature: A physical or electronic signature of a person authorized to act on behalf of the copyright owner whose rights are allegedly infringed. This person should be the copyright owner or legally authorized to represent their interests.
2. Identification of the Work(s)
- Identification of the Copyrighted Work: A clear identification of the work or works you claim are infringing. This can be a title, a description, or any other information that allows us to identify the work.
3. Identification of the Infringing Material
- Description of the Infringing Material: Provide sufficient details about the allegedly infringing material. Include the URL or other location information so that Fashion Open Studio can locate the material and verify its existence. This step is essential to help us quickly identify and act on the infringement claim.
4. Your Contact Information
- Your Contact Information: Include your full name, address, telephone number, and email address. This is necessary to follow up with you regarding your complaint.
5. Good Faith Statement
- Statement of Good Faith: A statement confirming that you have a good faith belief that the material is not authorized by the copyright owner, their agent, or the law. This statement must be included to verify that your complaint is legitimate.
6. Accuracy Statement
- Accuracy of Information: A statement affirming that the information in your notice is accurate and, under penalty of perjury, that you are authorized to act on behalf of the copyright owner.
Once we receive a properly completed notice of infringement, we will follow the DMCA’s procedures for removing the infringing material. We may notify the user who posted the infringing material and provide them with an opportunity to respond.
Counter-Notice Procedure
If you believe your content was removed due to a mistake or misidentification (for example, if you are the copyright owner and believe your content was wrongly removed), you may submit a Counter-Notice. A counter-notice must include the following information:
- Your full name, address, and phone number.
- A description of the removed content and the URL where it was located before it was removed.
- A statement under penalty of perjury that you believe in good faith that the material was removed by mistake or misidentification.
- A statement that you consent to the jurisdiction of the federal court in the district where you reside (or if you are outside the United States, the jurisdiction of a U.S. court).
- Your signature (physical or electronic).
After we receive a valid counter-notice, we may reinstate the removed content unless the original complainant files a lawsuit to prevent it.
Repeat Infringer Policy
Following the DMCA, Fashion Open Studio reserves the right to terminate the accounts of users who are repeat infringers. A repeat infringer is someone who has been notified of infringing activity and has not taken corrective action or been the subject of multiple infringement claims.
Important Notes
- False Claims: Submitting a false or misleading DMCA claim may result in legal action, including but not limited to damages for any losses suffered due to the wrongful content removal.
- No Responsibility for Infringing Content: Fashion Open Studio does not pre-screen or actively monitor content submitted by users or affiliates. We are only responsible for responding to DMCA notices as they are submitted.
